MedTech Compliance

Compliance for MedTech: GDPR, MDR, NIS2, and the EU AI Act from a single source

MedTech companies – including medical device manufacturers, medical software providers, and digital health startups – face one of the most complex regulatory environments in existence. GDPR, the EU Medical Device Regulation (MDR/IVDR), ISO 13485, NIS2, and the EU AI Act all overlap and must be complied with simultaneously. Proliance supports MedTech companies across the DACH region in implementing data protection, information security, and AI governance in a structured, legally compliant manner without unnecessary overhead.

Regulatory overview

Why MedTech compliance is about more than just GDPR

MedTech companies operate at the intersection of medicine, technology, and regulation. Multiple sets of rules apply simultaneously, often influencing one another. What counts as full compliance in other industries is often just the starting point in the MedTech sector.

Triple regulation: GDPR + MDR / IVDR + EU AI Act
MedTech companies must manage data protection, product approval, and AI governance in parallel. The EU Medical Device Regulation (MDR) and the In Vitro Diagnostic Regulation (IVDR) set their own requirements for patient data, technical documentation, and traceability – in addition to the GDPR and the EU AI Act for AI-supported products.
Software as a Medical Device (SaMD): A different set of rules
Anyone developing software that fulfils medical purposes must comply with IEC 62304 – with strict requirements for the software lifecycle, risk classification, and documentation. Data protection and information security are not optional add-ons here, but a prerequisite for approval.
Certification pressure as a barrier to market entry
Hospitals, health insurance providers, and international clients require ISO 13485, ISO 27001, and NIS2 evidence before signing contracts. During the due diligence process, investors assess the maturity of your compliance structures. If you cannot deliver here, you lose deals – regardless of product quality.
Lack of internal regulatory expertise
Most MedTech companies – especially startups and medium-sized manufacturers – do not have a dedicated regulatory affairs team. Data protection, information security, and MDR compliance are often managed on the side by a few individuals. That does not scale.
AI in medical devices: Additional obligations under the EU AI Act
An increasing number of MedTech products use AI – for diagnostics, image analysis, or clinical decision support. The EU AI Act classifies many of these applications as high-risk AI and obliges manufacturers to conduct risk analyses, meet transparency requirements, and ensure human oversight.

Testimonials

Over 3,000 companies work with Proliance – including MedTech manufacturers and medical software providers

The new Record of Processing Activities (RoPA) 2.0 delivers exactly what we need in our day-to-day IT operations. The automated suggestions for legal bases are helpful, without restricting our own structuring or documentation. Particularly valuable is the ability to flexibly build out our own areas and processing activities.
We had individual documents and policies, but lacked a comprehensive strategy or regular risk analyses. That's why I sought a partner for a holistic solution – from GAP analysis to ongoing support. Today, we have constant access to expert knowledge and are well-prepared for future requirements like NIS2 or new AI regulations.
With Proliance, we are systematically implementing GDPR and are now also approaching NIS2 compliance with a clear framework. We particularly value the combination of an intelligent platform, expert knowledge, and pragmatic implementation – our audit preparation time has been significantly reduced. For mid-sized companies, this is the key to making compliance reliable and scalable.
We were looking for a professional, comprehensive data privacy solution. With Proliance, we are in good hands and receive comprehensive advice!
Proliance helped us take our company's data protection to the next level. The team's expertise and quick responsiveness supported us every step of the way. Highly recommended.

FAQs

Frequently asked questions about data protection audits

Does my MedTech company need a data protection officer?

Yes – in most cases. MedTech companies regularly process health data under Article 9 of the GDPR, which generally makes the appointment of a Data Protection Officer mandatory. This requirement also applies if 20 or more people are permanently involved in automated data processing. An external DPO with MedTech expertise is often the most efficient solution – Proliance takes on this role for MedTech companies throughout the DACH region.

What does the EU MDR regulate regarding data protection and information security?

The EU Medical Device Regulation sets out specific requirements for handling clinical data, post-market surveillance, and technical documentation – areas that overlap with the GDPR and ISO 27001. Manufacturers must ensure that patient data is processed in compliance with the GDPR and protected by appropriate security measures. Proliance integrates all three areas of requirement into a coherent compliance strategy.

How do the GDPR, ISO 13485 and information security relate to one another?

ISO 13485 governs the quality management system for medical device manufacturers, yet it does not contain its own data protection requirements. However, many processes—such as traceability, customer complaints, and clinical evaluation—involve personal data and must be designed to be GDPR-compliant. ISO 27001 complements the system by addressing information security. Proliance aligns all three requirements and integrates them into a single, unified system.

What is Software as a Medical Device (SaMD) and what compliance obligations apply?

SaMD is software that independently fulfils medical purposes, such as diagnosis, monitoring, or therapy support. It is subject to the EU MDR, must be developed in accordance with IEC 62304, and processes highly sensitive patient data. GDPR compliance, Data Protection Impact Assessments (DPIA), information security under ISO 27001, and, where applicable, AI governance under the EU AI Act are not optional extras, but prerequisites for approval. Proliance supports SaMD manufacturers throughout the entire compliance development process.

Does NIS2 apply to MedTech companies?

This depends on your role in the supply chain. MedTech companies that are classified directly as critical infrastructure, or that supply critical infrastructure, may fall under the scope of NIS2. The directive mandates enhanced security measures, incident reporting obligations, and regular compliance documentation. Proliance will analyse your specific NIS2 requirements and support you every step of the way, from the initial gap analysis to ISO 27001 certification.

What does the EU AI Act mean for MedTech manufacturers?

AI-powered medical devices – such as those used for diagnostic imaging, clinical decision support, or automated risk classification – are frequently classified as high-risk AI under the EU AI Act. This entails risk assessments, transparency obligations, human oversight, and comprehensive documentation. Proliance helps you classify your AI applications, establish an AI governance framework, and integrate the requirements of the AI Act into your existing MDR processes.
