Generally yes, provided that at least 20 people are permanently involved in the automated processing of personal data (Section 38 of the German Federal Data Protection Act, BDSG). Smaller businesses may also be required to appoint one, for example, if they carry out particularly high-risk data processing. With an external data protection officer from Proliance, you can fulfil this requirement without the need to create an internal position.
All data relating to individuals: client and customer details, contact information for planners and subcontractors, employee records, job applications, and camera and time-tracking data. Purely technical plans that do not contain personal data are not included in this category, but must still be protected as trade secrets and through information security measures.
This is possible under certain conditions, for example to prevent theft, provided there are no less intrusive means available and the interests of the individuals concerned are protected. Typical requirements include warning signs, short retention periods, and ensuring that public areas or employees are not recorded without a legal basis. Each case must be assessed individually. We are here to support you with this.
If you use external service providers to process personal data on your behalf (e.g. cloud storage, planning or construction platforms, payroll accounting), you require a data processing agreement in accordance with Article 28 of the GDPR. You can manage your service providers and contracts centrally within the platform.
This depends on your sector and company size. Not every business is directly affected, but many are receiving requirements from clients who are. Use our free NIS2 check to get an initial assessment.
Yes, a brief framework makes sense. The EU AI Act requires companies using AI to ensure their employees have sufficient AI literacy. From a data protection perspective, it needs to be clarified which data can be used in which tools. We will create a clear, easy-to-understand policy and train your team.
Companies with generally 50 or more employees are required to establish an internal reporting channel in accordance with the Whistleblower Protection Act. With Proliance Whistle, you receive a reporting channel, documentation, and case management all in one.
The most effective approach combines both. The Proliance 360 platform documents and displays your status, while our experts answer legal questions and handle time-consuming tasks. This allows you to maintain control without needing to become an expert yourself.
